PUBLIC HEARING ON PROPOSED ZONING CHANGE

Tuesday, April 1, 2025 - Continued to May 6, 2025

The Zoning Commission of Amherst Township will hold a Public Hearing on a proposed amendment to the Amherst Township Zoning Resolution that was initiated by an application from Jacob Shield of Grey Fox Capital on behalf of the property owners.


The hearing will be held at the Amherst Township Hall, 7530 Oberlin Road, Elyria, on April 1, 2025 at 6:30 p.m.  The application to amend the Zoning Resolution will be available for examination for a period of ten days from March 21, 2025 to April 1, 2025, at the Amherst Township Hall, 7530 Oberlin Road in the outside bulletin board.


Following is a list of all properties to be rezoned or redistricted by the proposed amendment and the names of owners of these properties, as they appear on the County Auditor’s current tax list:

   PP 05-00-048-000-015 located at 45850 Telegraph Road, Elyria, Ohio, 44035

   Owned by Sliman Barbara J Trustee & Five S Incorporated.


The present zoning classification of the properties named in the proposed amendment is a combination of R-AG (Agricultural/Residential) and GB-1 (General Business). The proposed zoning classification is R-1 CON (Low Density Residential with Conservation). After conclusion of the hearing, the matter will be submitted to the Board of Trustees for further action.

The Zoning Commission of Amherst Township will hold a public hearing on a proposed amendment to the Amherst Township Zoning Resolution that was initiated by Camco Properties LLC on behalf of property owners, P and P Partnership LTD.


The hearing will be held at the Amherst Township Hall, 7530 Oberlin Road, Elyria, on June 3, 2025 at 6:30 p.m.  The applicationto amend the Zoning Resolution will be available for examination for a period of ten days from May 23, 2025 to June 3, 2025, at the Amherst Township Hall, 7530 Oberlin Road in the outside bulletin board.


Following is a list of all properties to be rezoned or redistricted by the proposed amendment and the names of owners of these properties, as they appear on the County Auditor’s current tax list:  Vacant land on Leavitt Road, PP#’s 05-00-045-000-088, 05-00-046-000-001, 05-00-046-000-028, & 05-00-056-000-066 and 45775 Middle Ridge Road, PP# 05-00-045-000-040, all properties owned by P and P Partnership LTD; and 45825 Middle Ridge Road, PP# 05-00-045-000-059 and 45900 Middle Ridge Road, PP# 05-00-045-000-026 both owned by Reborn LLC.


The present zoning classification of the properties named in the proposed amendment is MU-3 (Mixed Use Overlay – Retail/Office/Residential), GB-1 (General Business), and R-AG (Residential-Agricultural). The proposed zoning classification is R-1 CON (Low Density Residential with Conservation Development) and GB-1 (General Business). After conclusion of the hearing, the matter will be submitted to the Board of Trustees for further action.

ZONING COMMISSION

Membership

The Amherst Township Zoning Commission consists of five (5) members appointed by the Township Trustees.  The members serve a term of five (5) years and their terms expire individually, one per year.  Members of the Zoning Commission shall be residents of the unincorporated portion of Amherst Township.  The Township Trustees may also appoint up to two (2) alternate members to the Zoning Commisssion.


Powers and Duties

The Zoning Commission shall have the following Powers & Duties:

  1. Prepare Zoning Resolutions
  2. Review all site plans and applications
  3. Review all proposed Zoning Amendments and submit a recommendation to the Township Trustees


Meetings

The Zoning Commission regularly scheduled meeting is the First Tuesday of each Month at 6:30 PM in the Township Hall.  Other meetings may be scheduled as needed by the Chairman of the Commission. Meetings are open to the Pubic.

BOARD OF ZONING APPEALS

The Board of Zoning Appeals consists of five (5) members appointed by the Township Trustees.  Members shall be residents of the unincorporated portion of Amherst Township.  The members serve a term of five (5) years and their terms expire one per year.  The Township Trustees may also appoint up to two (2) alternate members to the Board of Zoning Appeals.


Powers & Duties

The Board of Zoning Appeals shall have the following Powers & Duties:

  1. To hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by the Zoning Inspector in the enforcement of the Amherst Township Zoning Resolution.
  2. To authorize, upon appeal, in specific cases, such variance from the terms of the Amherst Township Zoning Regulations as will not be contrary to the public interest, where owing to special conditions, a literal enforcement of this Resolution will result in unnecessary hardship, and so that the spirit of the Resolution shall be observed and substantial justice done.
  3. To exercise such powers as may be granted to the Board by the Amherst Township Zoning Resolution, amendment thereto or by the general laws as set forth in the Ohio Revised Code as amended.
  4. To review and decide all applications for conditional use permits according to the standards, criteria and procedures of the Amherst Township Zoning Resolution.
