PUBLIC HEARING ON PROPOSED ZONING CHANGE

Amherst Township Zoning Commission

THIS HEARING HAS BEEN CONTINUED TO NOVEMBER 5, 2019

IMMEDIATELY FOLLOWING THE REGULAR MEETING AT 6:30 PM.


The Zoning Commission of Amherst Township will hold a Public Hearing on a proposed amendment to the Amherst Township Zoning Resolution that was initiated by application of property owners.


The hearing will be held at the Amherst Township Hall, 7530 Oberlin Road, Elyria, on

Tuesday, October 15, 2019 at 6:30 pm. The application to amend the Zoning Resolution

will be available for examination for a period of ten (10) days from October 5, 2019 to

October 14, 2019, in the outside bulletin board at the Amherst Township Hall.


Following is a list of all properties to be rezoned or redistricted by the proposed amendment and

the names of owners of these properties, as they appear on the County Auditor’s current tax list:

Parcel Number 05-00-065-000-035, located on Oberlin Road, Elyria

Owner: Arthur J. & Dalee Abraham


The present zoning classification of the properties named in the proposed amendment is R-AG.

The proposed zoning classification is L1.


After conclusion of the hearing, the matter will be submitted to the Board of Trustees for further action.

PUBLIC HEARING

Amherst Township Board of Zoning Appeals

Amherst Township BZA will conduct a Public Hearing on Thursday, October 17, 2019 at 7:00 pm at the Township Hall, 7530 Oberlin Road, Elyria, Ohio.  The purpose of the hearing is to consider an Area Variance request by Deanna Sterna, for 45125 & 45155 North Ridge Road, Amherst, for proposed new property lines.  A copy of this applilcation is available for public inspection at the Township Hall.

ZONING COMMISSION

Membership

The Amherst Township Zoning Commission consists of five (5) members appointed by the Township Trustees.  The members serve a term of five (5) years and their terms expire individually, one per year.  Members of the Zoning Commission shall be residents of the unincorporated portion of Amherst Township.  The Township Trustees may also appoint up to two (2) alternate members to the Zoning Commisssion.


Powers and Duties

The Zoning Commission shall have the following Powers & Duties:

  1. Prepare Zoning Resolutions
  2. Review all site plans and applications
  3. Review all proposed Zoning Amendments and submit a recommendation to the Township Trustees


Meetings

The Zoning Commission regularly scheduled meeting is the First Tuesday of each Month at 6:30 PM in the Township Hall.  Other meetings may be scheduled as needed by the Chairman of the Commission. Meetings are open to the Pubic.

BOARD OF ZONING APPEALS

The Board of Zoning Appeals consists of five (5) members appointed by the Township Trustees.  Members shall be residents of the unincorporated portion of Amherst Township.  The members serve a term of five (5) years and their terms expire one per year.  The Township Trustees may also appoint up to two (2) alternate members to the Board of Zoning Appeals.


Powers & Duties

The Board of Zoning Appeals shall have the following Powers & Duties:

  1. To hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by the Zoning Inspector in the enforcement of the Amherst Township Zoning Resolution.
  2. To authorize, upon appeal, in specific cases, such variance from the terms of the Amherst Township Zoning Regulations as will not be contrary to the public interest, where owing to special conditions, a literal enforcement of this Resolution will result in unnecessary hardship, and so that the spirit of the Resolution shall be observed and substantial justice done.
  3. To exercise such powers as may be granted to the Board by the Amherst Township Zoning Resolution, amendment thereto or by the general laws as set forth in the Ohio Revised Code as amended.
  4. To review and decide all applications for conditional use permits according to the standards, criteria and procedures of the Amherst Township Zoning Resolution.

ZONING VARIANCES AND APPEALS APPLICATIONS

Zoning Variance and Appeals Applications are available at the Township Hall from the Zoning Inspector.


Conditional Use Applications are available at the Township Hall from the Zoning Inspector.
